Terms of Service Last updated: 3 September 2026 These Terms of Service apply when you access the Backspace website or purchase products or services from Backspace. By purchasing a product or service from Backspace, you agree to these Terms. Please read them before purchasing. 1. About Backspace Backspace provides digital exposure education, privacy-focused resources and personal online exposure auditing services. Our Services Backspace currently offers services and digital products which may include: Safe Start Plans; Personal Exposure Audits; digital guides and educational resources; and other privacy and digital-exposure products or services described on our website. The exact scope of your purchase is the scope described on the relevant product or service page at the time you purchase. 3. Safe Start Plans A Safe Start plan is designed to help you understand and establish privacy boundaries and safer practices for your online presence. The service is based on information you provide to us through the relevant questionnaire and communications. You are responsible for providing information that is reasonably sufficient and accurate for us to perform the service. You should not provide personal information that is unnecessary for the plan. 4. Personal Exposure Audits A Personal Exposure Audit assesses the online profiles and identifiers you ask Backspace to investigate and may involve research into information that is publicly accessible online. Depending on the scope requested, this may include assessing: social media profiles; usernames and handles; publicly accessible search results; links between online profiles or identifiers; information exposed through publicly accessible sources; and other areas specifically included in the service description. You may provide additional identifiers where you specifically want Backspace to investigate whether those identifiers can be associated with your online presence. 5. Important Limitations of Exposure Audits The internet is constantly changing. Search results, platform data, account visibility, indexing, databases and publicly accessible information may change before, during or after an audit. A Backspace audit therefore represents an assessment based on the information and sources reasonably available at the time the audit is performed. An audit cannot guarantee that every piece of information relating to you will be identified. A finding that particular information was not identified during an audit does not guarantee that the information: does not exist; cannot be discovered by another person; will not become discoverable later; is not held in a source unavailable to Backspace; or cannot be connected to you using information, access, tools or techniques unavailable within the scope of the audit. Backspace will perform the purchased service with reasonable care and skill. 6. What Our Services Are Not Backspace provides educational and digital-exposure assessment services. Unless expressly stated otherwise, Backspace does not provide: legal advice; cybersecurity penetration testing; monitoring of private accounts or systems; access to unlawfully obtained information; guaranteed removal of information from the internet; guaranteed anonymity; or a guarantee against future identification, harassment, fraud, stalking, data breaches or other actions by third parties. Where appropriate, you should seek advice from a suitably qualified professional for legal, cybersecurity or other specialist matters outside the scope of our services. 7. Responsible Use You must only provide accounts, identifiers and other information that you are legally entitled to provide to us for the requested service. Backspace services must not be purchased or used for unlawful purposes or to facilitate harassment, stalking, intimidation, unauthorised access, surveillance or other harmful activity. We may refuse or discontinue a service where we reasonably believe the service is being requested or used for an unlawful or harmful purpose. Where this occurs, your statutory rights remain unaffected. 8. Information You Provide The quality and scope of an audit may depend on the information you provide. You are responsible for ensuring, to the best of your knowledge, that information you provide for the service is accurate. Backspace is not responsible for findings that could not reasonably be made because relevant information was incorrect, omitted or outside the agreed scope of the service. This does not affect our responsibility to perform the service with reasonable care and skill. 9. Prices and Payment Prices are displayed before purchase. Payment may be processed through third-party platforms including Stan and Stripe. Any applicable price and payment terms displayed at checkout form part of your purchase. 10. Delivery Digital products are supplied electronically. Personalised services such as SafeStart and Personal Exposure Audits are delivered electronically to the email address or other agreed delivery method associated with your order. Any delivery timeframe specifically agreed with you or stated as part of the service will apply. If no specific timeframe has been agreed, the service will be performed within a reasonable time. 11. Cancellation Rights for Services If you are purchasing as a consumer, you may have statutory cancellation rights under UK consumer law, including a 14-day cancellation period for certain contracts made online. If you specifically request that Backspace begins providing a personalised service during the statutory cancellation period, we may ask you to expressly request that the service begins early. Where the law allows, if you subsequently cancel after performance has begun at your express request, you may be required to pay an amount proportionate to the service already supplied. If the service has been fully performed during the cancellation period following the required express request and acknowledgement from you, your statutory right to cancel may be affected in accordance with applicable law. Nothing in these Terms limits any cancellation right you have under applicable consumer law. To request cancellation, contact contact@thebackspacehq.com. 12. Digital Content and Downloads Some Backspace products may consist of digital content supplied immediately after purchase. Where applicable, before immediate digital content is supplied during a statutory cancellation period, you may be asked to expressly consent to immediate supply and acknowledge that doing so may result in the loss of your statutory right to cancel once supply begins. This does not affect your statutory rights where digital content is faulty, not as described or otherwise does not meet the requirements of applicable consumer law. 13. Refunds and Problems With a Service If you believe a product or service has not been supplied as described or has not been performed with reasonable care and skill, please contact: contact@thebackspacehq.com We will consider the circumstances and provide any remedy required by applicable consumer law. Nothing in these Terms excludes or restricts your statutory consumer rights. 14. Intellectual Property Unless otherwise stated, Backspace owns or is licensed to use the intellectual property contained in Backspace reports, guides, educational materials, website content and other materials supplied as part of our services. When you purchase an audit or digital product, you receive the right to use the supplied material for your own personal purposes. You must not, without permission: reproduce or distribute our paid materials for commercial purposes; resell them; upload or make paid Backspace materials publicly available; represent Backspace materials as your own; or use our materials to create a competing commercial product. This does not prevent you from retaining and using your own audit report for its intended personal purpose. 15. Third-Party Platforms and Information Our services may refer to or assess information available through third-party websites, social networks, search engines and other services. Backspace does not control those third parties and is not responsible for their availability, policies, security practices, subsequent changes or decisions about information they host. References to third-party information or services do not constitute a guarantee or endorsement of them. 16. Liability Nothing in these Terms excludes or limits liability where doing so would be unlawful. Nothing in these Terms excludes your statutory consumer rights or our responsibility to provide services with reasonable care and skill. Backspace is not responsible for loss or harm caused solely by matters outside our reasonable control, including subsequent changes made by third-party platforms, websites or other independent services after an audit has been completed. The limitations inherent in online exposure research described in Section 5 also apply. 17. Privacy Personal information is handled in accordance with our Privacy Policy. Our Privacy Policy explains what information we collect, how we use it, who may process it and how long audit-related information is normally retained. 18. Changes to These Terms We may update these Terms where our products, services, business practices or applicable requirements change. Changes will apply from the date the updated Terms are published and will not retrospectively alter an existing purchase where doing so would unfairly reduce your rights. 19. Governing Law These Terms are governed by the applicable laws of Scotland. If you are a consumer, you retain any rights regarding where you may bring legal proceedings that are provided to you by applicable consumer law. 20.
